The Board of Environmental Protection published their proposed amendments to Ch. 428 of the regulations on September 24.The amended regulations will include the updated Appendix A – The Packaging Material Types List – which has gone through months of stakeholder input, which Consumer Brands has actively participated in and submitted comments on. |
The Board of Environmental Protection is scheduled to hold a public hearing on the amended regulations on October 16, with a deadline to submit public comment on October 27. |

On August 13, Circular Action Alliance submitted a proposal to amend its program plan. Specifically, the proposed amendments to the plan pertain to the responsible end market (REM) principles outlined in statute, providing a practical approach to achieving the REM goals while overcoming some of the risks and uncertainties expressed by the industry. |
Public comment on Circular Action Alliance’s amended program plan closes on October 15. |
| Colorado |
On August 14, Colorado’s Producer Responsibility Advisory Board submitted its approval recommendation memo for Circular Action Alliance’s amended Program Plan. Following the Board’s recommendation, CDPHE opened public comment on Circular Action Alliance’s amended Program Plan, which closed on Sunday, September 14. Also on August 14, CDPHE released their draft amendments to Section 18.9 of the regulations, specifically pertaining to the eco-modulation bonus schedule. On September 19, CDPHE released a third draft of the amendments to the eco-modulation regulations, and extended the public comment period to close on September 28. Consumer Brands has been heavily engaged in the rollout of Colorado’s program and submitted public comments on both the amended Program Plan on the amendments to regulations pertaining to the eco-modulation bonus schedule. |
Producers are required to remit their dues to Circular Action Alliance on or before January 1, 2026. |

On August 22, CalRecycle initiated formal rulemaking for California’s plastic and packaging reforms and released the revised final regulations for public review and comment. On August 26, CalRecycle released a Partially Recirculated Draft Program Environmental Impact Report for public review and comment. |
Public comment on the revised final regulations ends on October 7. Following the end of the public comment period, CalRecycle will hold a hybrid public hearing on the revised final regulations, also on October 7. Public comment on the Partially Recirculated Draft Program Environmental Impact Report ends at 8 p.m. EST on October 10. |

The Minnesota packaging extended producer responsibility advisory board continues to host meetings, with the purpose of advising program implementation. The most recent advisory board meeting took place on September 25. |

The Maryland Department of the Environment is currently holding monthly EPR Advisory Council meetings to discuss program elements and rollout. The last EPR Advisory Council meeting was held on September 11. |
The next Advisory Council meeting will take place on September 30. Meetings are held monthly on Thursdays from 9–11:00 a.m. EST. |

On September 9, the Washington Department of Ecology hosted the “Recycling Reform Act Kickoff Webinar,” providing attendees with an overview of Washington’s program and important upcoming dates and deadlines. |
The Washington Department of Ecology is currently accepting applications to serve on the Recycling Reform Act Advisory Council. The application period closes on October 6, and the Department will identify the council members by December 1. Due to overwhelming demand, the Washington Department of Ecology is hosting a second kickoff webinar on the Recycling Reform Act on October 7. |
